1. Acceptance of Terms
By accessing or using the Kutecart website (www.kutecart.com), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Mandatory Unboxing Video Policy (Anti-Fraud)
Kutecart operates on a strict “No Video, No Claim” policy. By placing an order, you agree to the following:
- The Condition: To claim a refund or exchange for damaged, missing, or incorrect items, you must provide a continuous, unedited unboxing video.
- The Procedure: The video must show the shipping label clearly, all sides of the sealed package, and the actual opening process without the package ever leaving the camera frame.
- The Waiver: Failure to provide this video as specified in our [Return Policy] constitutes a waiver of your right to any claim against Kutecart.
3. Limitation of Liability
To the maximum extent permitted by Indian law (Consumer Protection Act, 2019):
- Kutecart shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products.
- Our total liability for any claim shall not exceed the amount paid by you for the specific product in question.
4. Accuracy of Information & Right to Cancel
- Pricing Errors: We reserve the right to cancel any orders placed for products listed at an incorrect price due to typographical errors or technical glitches.
- Inventory: In the event of a stock error, we reserve the right to cancel the order and provide a full refund.
- Order Rejection: We reserve the right to refuse service or cancel orders from users with a history of fraudulent activity or suspicious chargeback behavior.
5. Shipping & Delivery
- Third-Party Carriers: Delivery is handled by third-party logistics partners. Kutecart is not liable for delays caused by carrier strikes, weather, or incorrect addresses provided by the customer.
- Risk of Loss: The risk of loss and title for items pass to you upon our delivery to the carrier.
6. Intellectual Property
All content on this site, including logos, images, and text, is the exclusive property of Kutecart. Any unauthorized use, reproduction, or “scraping” of our content for commercial purposes will result in legal action under the Copyright Act, 1957.
7. Grievance Redressal (Mandatory under Indian Law)

8. Chargebacks & Disputes
Initiating a chargeback without first contacting our support team or providing the mandatory unboxing video is considered a breach of this contract. We reserve the right to submit this ToS and your IP address to your bank as evidence of a valid transaction.
9. Jurisdiction
Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts located in Thrissur,Kerala,India.
